By accessing our website, booking our outdoor fitness services, or participating in any Nytelvora programs, you agree to be bound by these Terms of Use and our Privacy Policy.

Important: If you do not agree with any part of these terms, please do not use our services or participate in our outdoor fitness programs.

Agreement Scope

  • These terms apply to all users of our website and services
  • Participation in outdoor fitness activities constitutes acceptance
  • Parents/guardians must accept terms on behalf of minors under 18

2. Our Services

Nytelvora provides outdoor fitness training services in parks and natural environments across New South Wales, Australia.

Service Offerings

  • Group Outdoor Training: Structured fitness sessions in park environments
  • Personal Training: One-on-one outdoor fitness coaching
  • Specialized Programs: Seasonal fitness challenges and specialized outdoor activities
  • Fitness Consultations: Goal-setting and program planning sessions
  • Community Events: Group fitness challenges and outdoor wellness activities

Service Locations

Our primary training location is at parks and natural areas around 494 Arina Rd, Bargo NSW 2574. Additional locations may be used for special programs or events, with advance notice provided to participants.

3. Eligibility and Registration

Age Requirements

  • Adults (18+): Can register independently for all programs
  • Minors (Under 18): Require parental/guardian consent and supervision
  • Children (Under 12): Must be accompanied by a parent or guardian during sessions

Registration Process

  1. Complete our registration form with accurate personal information
  2. Provide emergency contact details
  3. Acknowledge fitness level and any physical limitations
  4. Accept waiver and risk acknowledgment forms
  5. Complete payment for selected programs

Health Considerations: Participants should consult their healthcare provider before beginning any new fitness program, especially if they have pre-existing conditions or concerns about physical activity.

4. User Responsibilities

Participant Obligations

  • Accurate Information: Provide truthful and complete registration details
  • Fitness Disclosure: Inform trainers of any physical limitations or concerns
  • Equipment Care: Respect and properly use any provided training equipment
  • Environmental Respect: Follow Leave No Trace principles in natural areas
  • Safety Compliance: Follow all trainer instructions and safety guidelines
  • Punctuality: Arrive on time for scheduled sessions

Prohibited Activities

  • Participating under the influence of alcohol or recreational substances
  • Bringing unauthorized equipment or weapons to training areas
  • Disrupting other participants or members of the public
  • Damaging park facilities or natural environments
  • Recording or photographing other participants without consent
  • Providing fitness advice or instruction to other participants (unless authorized)

Weather Preparedness: Participants are responsible for bringing appropriate clothing and gear for outdoor conditions. Check weather forecasts and dress accordingly.

5. Safety and Risk Acknowledgment

Inherent Risks

Outdoor fitness activities involve inherent risks that participants acknowledge and accept:

  • Uneven terrain and natural obstacles
  • Weather-related challenges (rain, wind, heat, cold)
  • Potential for cuts, bruises, or sprains during physical activity
  • Wildlife encounters in natural environments
  • Equipment-related risks when using park facilities

Our Safety Measures

  • All trainers are certified in first aid and CPR
  • Regular safety briefings before each session
  • Appropriate instructor-to-participant ratios
  • Emergency action plans for all training locations
  • Weather monitoring and session modifications as needed

Assumption of Risk: By participating in our outdoor fitness programs, you voluntarily assume all risks associated with physical activity in natural environments. You acknowledge that we cannot eliminate all risks inherent in outdoor exercise.

Emergency Procedures

In case of emergency during outdoor training sessions:

  1. Trainers will provide immediate first aid as needed
  2. Emergency services will be contacted if required
  3. Your emergency contact will be notified
  4. Incident reports will be completed as required by Australian regulations

6. Payment Terms

Pricing and Fees

  • All prices are displayed in Australian Dollars (AUD)
  • Prices include GST where applicable
  • Payment is required before participation in programs
  • We reserve the right to modify pricing with 30 days notice

Payment Methods

We accept the following payment methods:

  • Credit and debit cards (Visa, MasterCard, American Express)
  • Bank transfers for program packages
  • Cash payments for drop-in sessions (where available)
  • Digital wallets (Apple Pay, Google Pay)

Payment Processing

All payments are processed securely through PCI-compliant payment processors. We do not store your complete payment information on our servers. For subscription-based programs, you authorize automatic recurring charges until cancelled.

Monthly memberships auto-renew unless cancelled at least 48 hours before the next billing cycle.

7. Cancellation and Refund Policy

Session Cancellations

By Participants:

  • 24+ hours notice: Full credit or transfer to another session
  • 2-24 hours notice: 50% credit toward future sessions
  • Less than 2 hours: No refund or credit (except emergencies)
  • No-show: Full session fee applies

By Nytelvora:

  • Weather Cancellations: Full refund or reschedule option
  • Trainer Unavailability: Alternative trainer or full refund
  • Venue Issues: Alternative location or full refund

Program Refunds

  • Within 7 days of purchase: Full refund if no sessions attended
  • After 7 days: Prorated refund based on unused sessions
  • Monthly memberships: Can be cancelled with 48 hours notice before next billing
  • Annual packages: Refund available for unused portion minus 15% processing fee

Refund Processing: Approved refunds are processed within 5-7 business days to your original payment method. Bank processing times may vary.

8. Intellectual Property

Our Content

All content on our website and in our programs is protected by intellectual property laws:

  • Written Materials: Workout guides, nutrition tips, and educational content
  • Brand Elements: Nytelvora name, logo, and visual identity

Participant Acknowledgments

  • You are responsible for your own fitness level and limitations

  • You release Nytelvora from claims arising from your participation

Australian Consumer Law: Nothing in these terms excludes, restricts, or modifies any guarantee, condition, warranty, right or remedy which applies under the Australian Consumer Law and cannot be excluded, restricted or modified.

Insurance Coverage

We maintain comprehensive insurance coverage including:

  • Public liability insurance for outdoor training activities
  • Professional indemnity coverage for fitness instruction
  • Coverage for equipment and venue-related incidents
